Alfred Vargas and wife Yasmine claim resolution ‘disregarded’ material evidence

Alfred and Yasmine Vargas are filing for a Motion for Reconsideration following the decision made by the Office of the City Prosecutor of Manila on the case they filed against Rob Sy. In a joint statement, the two claimed that material evidence was “disregarded” in the resolution issued. 

The Office of the City Prosecutor of Manila previously junked the case filed by Alfred and his wife against Kapuso actor Rob Sy and his partner, Juvelle Bacosa. The lawsuit stemmed from the alleged bullying their son went through in the swim club, wherein he was allegedly pushed and held underwater.

Alfred and Yasmine’s camp maintained that the complaint they filed against the couple was not based on Republic Act No. 10627 or the Anti-Bullying Act of 2013, but rather Section 10(a) of Republic Act No. 7610 or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act.

“We respectfully believe that the Resolution erred in adopting restrictive interpretation of the law and failed to fully appreciate the totality of the evidence on record,” the two said in a joint statement.

Material evidence, which included eyewitness testimonies, reports, and professional psychiatric findings documenting the emotional and psychological impact suffered by their child, was “disregarded” the couple claimed. 

“These are precisely the kinds of acts and conditions that Republic Act No. 7610 seeks to prevent, particularly when they affect the dignity, emotional security, psychological well-being, and development of a child,” they added.

The couple emphasized how the resolution “did not give weight” to their child’s narration of events as well as the result of the psychiatric evaluation. They maintained that the legal battle has never been about publicity or retaliation but rather "ensuring that the law works.”

“It has always been about parents’ accountability, child protection, and ensuring that the law works for the very individuals it was designed to protect,” the couple maintained.

Rob and his partner have yet to respond to Alfred and Yasmine’s statement as of writing. 

Previously, Rob asserted that the 10-page decision is sufficient to show that their son did nothing wrong and is innocent of all the allegations leveled against him.
